Distance Sales Agreement
This contract is signed by Kalkan Mh. Vatan Cd. Eco Villa Kalkan (referred to as Eco Villa Kalkan in the Contract) located at No:55 Kaş-Antalya with the contact number +90 242 844 10 08 and, on the other hand, the person who is a member of www.ecovillakalkan.com and completes the online reservation process (as CONSUMER in the contract). between) The address, identity and contact information used by the consumer when becoming a member are taken as basis.
1- The consumer who purchases accommodation through our site is obliged to pay the full service fee at the time of reservation. The reservation is not finalized until full payment is made.
2- In case of a price increase in the contract price, the difference will not be requested from the consumer, and the discounts called actions by Eco Villa Kalkan will not be refunded to the consumer.
3- If it is not possible for the consumer to participate in the purchased accommodation service, he/she may transfer his/her reservation to a third party who will fulfill all conditions valid for the contract by notifying Eco Villa Kalkan at least 7 days before the start date of the accommodation. In this case, the person(s) transferring and taking over the contract are jointly responsible for the payment of the balance amount to Eco Villa Kalkan and all additional expenses arising from the transfer in question. If consumers do not have a visa or cannot obtain a visa from the relevant institution until the start date of their stay, despite having applied, Eco Villa Kalkan does not accept any responsibility and collects the entire accommodation fee from the transferor and transferee (severally). If the person transferring the service does not have the same status as the transferor, the transfer will not take place or the transfer process will be completed by removing the special discounts.
4- Eco Villa Kalkan may partially/completely change or cancel the reservation before the start of the service or during the service, for a reason not caused by the consumer. The consumer can accept these changes or accept another alternative service offered by Eco Villa Kalkan. If the consumer does not accept the changes, he has the right to cancel his reservation and receive a full refund of the fee paid within the scope of the contract. Although Eco Villa Kalkan has taken all necessary care, it prevents the start or continuation of the service; may cancel or postpone the reservation due to strike, terrorism, possibility of war, unforeseen technical issues and all similar force majeure reasons. In case of cancellations made by the consumer up to 30 days before the start of the accommodation period, the price paid will be refunded to the consumer, excluding the costs arising from compulsory taxes, duties and similar legal obligations. If the consumer requests cancellation less than 7 days before the start of the stay, the consumer declares, accepts and undertakes to pay the entire contract fee to Eco Villa Kalkan. In case the consumer requests a change in the service, provided that this change is deemed appropriate by Eco Villa Kalkan, if there is a price difference between the previously received service and the new service requested, the consumer must immediately pay the difference to Eco Villa Kalkan upon acceptance of the change request.
However, if the price of the new service is lower than the previous service price, Eco Villa Kalkan will refund the difference to the consumer. The reservation cancellation request will be accepted, provided that the consumer certifies the illnesses that prevent him or his first-degree relatives from performing their usual activities for 10 days, corresponding to the accommodation period, with an official report to be obtained from the Full-fledged State Hospital or in case of death, and the reservation cancellation request will be accepted and the costs arising from the obligatory taxes, duties and similar legal obligations will be covered. The amount paid by the consumer is refunded to him/her, except for the non-refundable amounts that can be paid and documented to third parties. In this case, the report and documents will be submitted before the start of the service. If the consumer does not notify in writing that he will participate in the accommodation service whose start he missed; Eco Villa Kalkan has the right to cancel all reservations and services made on behalf of the consumer after 24 hours. In such cancellations, no refund will be made to the consumer.
5- Eco Villa Kalkan and the consumer will duly fulfill their obligations arising from this agreement.
6- Eco Villa Kalkan is obliged to deliver to the consumer the Preliminary Information Form/Voucher/Email, which contains preliminary information regarding the qualifications of the service subject to this contract, the sales price and payment method, and the performance, as specified in Article 8 of the contract. Eco Villa Kalkan is not responsible for situations arising from the consumer or the personal responsibilities of third parties.
7- Consumers who purchase services with a credit card must notify their early payment or installment reduction requests to the bank to which the card belongs and make them to the payment branches determined by the bank. When consumers cancel the service they purchased in installments by credit card for any reason, Eco Villa Kalkan will refund the fee received from the credit card to the consumer's credit card. The refund is returned to the consumer's card according to the banks' business rules. Bank rules also apply to refunds for payments made in installments, and Eco Villa Kalkan has no liability or possibility of intervention if the payments made in installments are returned to the card in installments.
8- All notifications that Eco Villa Kalkan will provide to the consumer can be made in writing by hand or through a permanent data provider (e-mail, text message, disk, CD/DVD, memory card and any similar tool or medium). In accordance with the duty of care, the consumer is obliged to notify Eco Villa Kalkan if the contract is not performed at all or properly within 30 days from the date on which the service should be performed or is performed. Notifications made after this period will be deemed invalid. The consumer gives the following information to Eco Villa Kalkan employees and/or websites during the reservation; e-mail, mobile phone, fax etc. acknowledges and declares that he/she allows the information, newsletter submissions made by Eco Villa Kalkan and its websites for campaign announcement purposes. If the consumer declares that he does not want notifications and announcements made to his communication channels, Eco Villa Kalkan undertakes to terminate e-mail, SMS, fax and postal sending.
9-All Antalya Enforcement Offices and Courts of the Republic of Turkey, Consumer Arbitration Committees and other organizations authorized by law are authorized to resolve all disputes arising from this agreement. If one or more articles of the contract are deemed invalid for any reason, the other provisions of the contract will not be affected by this invalidity and will remain in force. This contract has been drawn up in accordance with the provisions of the Consumer Protection Law No. 6502, and the provisions of Law No. 6502 and relevant regulations are valid for matters not regulated in the contract. By signing this contract/approving it electronically, the consumer is deemed to have accepted and undertaken the terms of the contract.
